All the products in our online store are customized according to the specifications provided by the users. All items for sale are subject to availability and to acceptance of the order by Bitprom. Bitprom reserves the right to modify the specifications of any items without prior notice. Such modifications will take effect as from the date of their publication on our website.
Bitprom will make every effort to illustrate and describe as accurately as possible the colors of the products shown on the website and in quotations, but does not undertake to guarantee that the colors of the supplied products will exactly match those viewed on the user's/customer's monitor.
Any offers or promotions will be valid until the date indicated in each offer or promotion, or, where applicable, until stocks are exhausted.
To place an order, it must be done through the website and you will then receive confirmation from the customer service department. The customer will have to validate the order, and such validation shall expressly imply awareness and acceptance of these General Terms and Conditions of Contracting as part of the conclusion of the contract, which Bitprom will make available to the customer by publishing them on this website so that they may be consulted. The customer must be of legal age.
The products purchased by users may be displayed on Bitprom's website for advertising purposes.
ORDER
No order shall be deemed accepted by Bitprom unless Bitprom has unconditionally confirmed the order. The company reserves the right to reject any order with no obligation to state its reasons. If your offer is not accepted and you have already made a payment on account, the amount paid will be fully refunded.
Bitprom's customer service department will request the personal data that will be incorporated into our database in order for Bitprom to process the order and to facilitate future purchases. Furthermore, you will be able to access your personal data.
Personal data must be provided fully and accurately in order to avoid incidents/confusion with the order or the shipment of the purchased products. If requested, you will receive by email information and publications relating to Bitprom.
The customer may customize each item with an image, text or logo. In such case, if the customer wishes to customize with an image or logo, he/she must provide all the necessary material in good quality for the order requested. Bitprom will endeavor to illustrate and describe as accurately as possible the customization of its products in its quotations, which shall serve as proof of the customer's consent.
Each order with customization will be reviewed in advance by Bitprom. Bitprom reserves the right to adapt the customization designs if the printing process requires it; in such a case, a final proof will be sent to the customer by email for his/her approval.
There may be minimal differences between the printed products and the designs displayed on the screen or sent by email.
PRICE AND CURRENCY
Each item will have a price determined by Bitprom and will be stipulated according to the customer's request. The prices of all products published on Bitprom's website include VAT (21%) and exclude shipping costs.
VAT is added to the unit price of the product and is therefore already included in the prices on Bitprom's website. The customer will be responsible for any other taxes applicable in the territory to which the order is shipped.
All Bitprom products will be presented and sold in EUROS (€). Payment shall be made by bank card or bank transfer. No other means of payment will be accepted.
The customer undertakes that all data provided to Bitprom for the order and delivery are correct and that the payment method chosen is legitimate and that there are sufficient funds or credit available to cover the total cost of the products ordered from Bitprom. The company that owns the website reserves the right to obtain validation of the buyer's credit or debit card or of the bank transfer before accepting and/or shipping the customer's order.
SHIPPING
The customer accepts that the shipping conditions take effect at the time the order is delivered to the carrier.
The order will be prepared within 3 working days and will be shipped 48 hours thereafter.
To avoid incidents in the delivery of the order (incorrect delivery addresses, inability to find anyone at the address, etc.), it is essential that you correctly provide your details and contact telephone numbers. If the customer unjustifiably refuses to accept delivery of the products or does not provide sufficient information or instructions or the necessary cooperation to receive the delivery of the products and/or the provision of services, Bitprom shall not be obliged to refund the price and shall have the right to take any measures it deems appropriate in this regard at the customer's cost and risk.
Bitprom will endeavor to process the order and manufacture the products within the period specified for each item. The delivery times for products sold on Bitprom's website are indicative, as said delivery times are not essential to the contract, and Bitprom shall not be liable for any loss or expense incurred by the customer as a result of delayed delivery of the products, regardless of the cause. Bitprom reserves the right to deliver the products in different shipments. If the complete order is delivered in several shipments, each delivery shall constitute a separate contract. The purchaser/customer may not terminate the contract as a whole if Bitprom cannot comply with one or more of the deliveries, or if the customer has a claim in relation to one or more of the deliveries.
The user has the right to withdraw from the contract within 14 calendar days from receipt of the product, in accordance with consumer and user protection regulations.
However, in accordance with Article 103 of Royal Legislative Decree 1/2007, this right shall not apply to products made to the consumer's specifications or clearly personalized.
Given that the products offered by BITPROM INVESTMENT, S.L. are customized according to the customer's instructions, the right of withdrawal is not accepted once the order has been confirmed. This provision does not affect other rights recognized to the consumer under current legislation.
In the context of COVID-19 and for hygienic reasons, returns will not be accepted for protection and health products.
At the time of delivery, the customer must inspect the delivery in order to detect any defect. If it is considered that there is a defect and that the order does not conform to the contract, Bitprom must be contacted within 15 working days at the email address info@bitprom.com, providing all possible information (order number and details of the damage, as well as photographic evidence thereof) and returning the items in their original packaging. We will then inform you how to proceed with the return of the defective products depending on the place of delivery.
Returns of products that have been used or show signs of tampering will not be accepted.
Items sold in packs or sets are indivisible, so partial returns will not be accepted.
In the event of force majeure on the part of Bitprom, Bitprom shall have the right to suspend execution of the contract or, at its discretion, partially or fully terminate the contract without being obliged to compensate the customer.
Force majeure on the part of Bitprom is limited to any circumstance that results in it being unreasonable to expect Bitprom to fulfil the contract. This may include transportation problems, failure by Bitprom's suppliers to fulfil their obligations, any failure by third parties contracted by Bitprom to perform the agreement, restrictive government measures of any kind (including the failure to obtain necessary permits), disruptions, cessation or interruption in the supply or functioning of any public utilities, raw materials, semi-finished and/or finished products, as well as any circumstance that Bitprom could not reasonably have foreseen and over which Bitprom has no control.
Unless expressly provided otherwise in these conditions, our liability in relation to any product purchased shall be strictly limited to the purchase price of said product.
The customer is the holder of all rights, including intellectual property rights, over the logos and/or images chosen by him/her to customize the product. If you are not the holder of all such rights, you state that you have the express authorization of the holder to use them. Under no circumstances shall Bitprom be liable to third parties for claims related to copyright or intellectual property rights.
The customer shall indemnify Bitprom against any third-party claims as a result of an infringement of an intellectual property right in relation to the manufacture, delivery or use of a product or service made or provided according to the customer's specifications. This indemnification shall also apply if Bitprom must modify an existing item or work following the customer's instructions.
In the event that the customer infringes copyright, Bitprom shall not in any case and under no circumstances be held liable.
Applicable regulations require that part of the information or communications we send you be in writing. Validation of the order by the customer implies awareness and acceptance that most of such communications with us will be electronic. You acknowledge that contracts, notices and other communications that we send to you electronically comply with the legal requirement that they be in writing. This condition does not affect the rights granted to you by law.
If any of these conditions or any provision of a contract are declared null and void by a final decision of a competent authority, the remaining terms and conditions shall remain in force and shall not be affected by such declaration of nullity.
In compliance with the Spanish Organic Law on Data Protection and Guarantee of Digital Rights, we inform you that we process the information you provide us with for the purpose of providing the requested service and billing for it. Your explicit consent constitutes the legal basis for the processing of your data. Such data will form part of our database for the time necessary to provide the service or to comply with legal obligations.
Personal data will not be disclosed to third parties except where there is a legal obligation and/or where necessary to provide the requested service. You may withdraw your consent and exercise your rights of access, rectification, objection, restriction, portability and erasure of data before the data controller, as well as lodge a complaint with the competent supervisory authority (AEPD).
The use of our website and the purchase contracts for products shall be governed by Spanish law. Any dispute arising out of or in connection with the use of the website or with such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals. If you are contracting as a consumer, nothing in this clause shall affect the rights that you are recognized as having under current legislation.
The holders of balance-wallet accounts and of cards used to pay for their products shall be responsible for the transactions carried out by them on this website.

Temporal scope
Promotions will be run weekly, monthly or on specific dates (such as Christmas) or with different periodicity, with the validity of each promotion being as specified for that promotion.
Personal scope
All persons over 16 years of age, resident in Spain and who comply with these terms and conditions may take part in Bitprom's promotions.
Territorial scope
The scope of application shall be within mainland Spain and the Balearic and Canary Islands.
Acceptance of the terms
Acceptance of the terms implies full acceptance of these participation terms, as well as of Bitprom's decisions with regard to the resolution of the prize draw as set out in these terms.
Execution of the promotion
Participation in the promotion will take place as follows:
Promotions will be carried out through our digital platforms (Facebook and Instagram).
The winner(s) of each promotion will be duly announced on these social media accounts and must contact Bitprom to provide their details, which will be used for the delivery or shipment of the prize(s). The result will always be published in the feed of each social network and in stories to facilitate communication.
Unless otherwise stated, all promotions will have one (1) winner, by combining the participants from Facebook and Instagram and carrying out a random draw.
Any participants who make abusive or fraudulent use of the promotion, or use applications that influence the probability of winning the draw, or participate through bots, will be excluded.
To participate, it will be necessary to comply with the following requirements:
Prizes
The prizes will be determined by Bitprom and may be Bitprom's own products or products unrelated to Bitprom's activity.
Each promotion will have a different economic value.
Only one prize per household/address will be valid, even if the people are different. Group participation will not be valid.
Bitprom reserves the right to request the winner(s)' identification by means of their ID card or passport. If the winner refuses to provide such documentation or if the information does not match the data provided, the right to receive the prize will be forfeited.
The winners will be chosen by draw with a certificate thereof, and Bitprom reserves the right to modify the dates that may be indicated, where applicable.
Prizes consisting of Bitprom's own products that are customizable will be subject to the default marking dimensions for each promotional gift and to Bitprom's criteria for marking or printing. In addition, if any Bitprom products drawn as prizes are out of stock after the draw, the prize will be replaced with a similar product.
Communication and delivery of prizes
Communication
Within a minimum period of three (3) calendar days, the winner of the promotion will be announced, always counting from the end date of the promotion.
The prize will be declared void if six (6) calendar days elapse from the time Bitprom publishes the name(s) of the winner(s) and no reply is received from the winner(s).
Delivery
The prizes will be delivered within a maximum period of one (1) month from the publication of the winners, either by collection at our facilities or by home delivery if collection at our facilities is not possible. If specified in the draw, collection of the prize shall be solely and exclusively at our facilities.
If no one is found at the address, the winner(s) will be notified and will have a maximum period of one (1) month from the date the prize is sent.
Prizes will be delivered within mainland Spain. Second shipments will not be covered by Bitprom.
Acceptance of the prizes
Renunciation of the prizes will not give rise to any right to compensation or financial indemnity.
Bitprom, as the organizer of the promotion, shall not be liable for any complaints arising from the enjoyment of the prize or from expectations regarding the prize. Likewise, it shall not be liable for errors in the data provided by the participant that may prevent correct identification or shipment.
Privacy and personal data protection
Bitprom Investments SL is the controller of the data supplied by all participants. These data will be used to manage and administer the promotion, contest or prize draws. By participating, you accept these terms and conditions and authorize that your name and image may be published in the media used for dissemination (Facebook, Instagram or other digital platforms).
